ALTIUS HOST LLC respects the intellectual property rights of others and expects our clients to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512.
In accordance with 17 U.S.C. § 512(c)(2), ALTIUS HOST LLC has designated the following agent to receive notifications of claimed copyright infringement:

To be effective under the DMCA, a written notification must include substantially the following, as set out in 17 U.S.C. § 512(c)(3)(A):
1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single site are covered by a single notification, a representative list of such works.
3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate it — in practice, the complete URL of the specific page or file.
4. Information reasonably sufficient to permit us to contact you: name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Warning regarding false claims. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
Upon receipt of a compliant notification, we will act expeditiously to remove or disable access to the material identified, and will forward a copy of the notification to the client responsible for the affected account.
Because we act as a hosting provider rather than the publisher of client content, we may in the first instance forward the notice to the client with a short deadline for removal, unless immediate action is required.
If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated agent containing substantially the following, as set out in 17 U.S.C. § 512(g)(3):
1. Your physical or electronic signature.
2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, for any judicial district in which ALTIUS HOST LLC may be found — and that you will accept service of process from the person who provided the original notification or an agent of that person.
Upon receipt of a valid counter-notification, we will promptly forward a copy to the original complainant and inform them that we intend to restore the material. In accordance with 17 U.S.C. § 512(g)(2)(C), and unless the complainant first notifies us that they have filed a court action seeking to restrain the allegedly infringing activity, we will restore the removed material not less than ten (10) and not more than fourteen (14) business days following receipt of the counter-notification.
In accordance with 17 U.S.C. § 512(i), ALTIUS HOST LLC maintains and reasonably implements a policy providing for the termination, in appropriate circumstances, of the accounts of clients who are repeat infringers. Accounts subject to multiple substantiated infringement notices may be suspended or terminated without refund.
This page concerns copyright infringement specifically. Notices concerning any other category of unlawful content — regardless of the law under which it is unlawful — should instead be submitted through our general notice and action mechanism at [email protected], as described in Section 10 of our Terms of Service.
Our physical server infrastructure is located within the European Union, and content hosted with us is additionally subject to the national law of the country in which the account is hosted and to European Union law. Where our services fall within the scope of Regulation (EU) 2022/2065 (the Digital Services Act) or a comparable notice-and-action regime, the mechanism described in Section 10 of our Terms of Service is intended to satisfy those requirements, and any client whose content is restricted receives a statement of reasons together with the means to contest the decision.
This page is published in fulfilment of the requirement under 17 U.S.C. § 512(c)(2) that a service provider make the contact information of its designated agent available to the public on its website.
